Hospital policy prohibited operating department personnel from wearing artificial fingernails. One of the surgical technicians had already been disciplined more than once for breaking this rule. The operating department nurse manager was responsible for enforcing hospital policies. She confronted this surgical technician and demanded that the technician take her hands out from under a blanket so that the nurse manager could see her nails. When the technician refused, the nurse manager grabbed the technician’s right hand. The technician sued the nurse manager for assault and battery.
